The Workplace Relations Commission has ordered Project Tile Design Ltd to re-engage Karen Kinsella in her former role after finding her dismissal unfair. In a decision dated 11 July 2025, it said the period between dismissal and re-engagement must be treated as unpaid suspension.
The company said it dismissed Kinsella over breaches of its harassment policy and procedures. The WRC found serious flaws in the investigation and disciplinary process, including that the company began a formal investigation without the written grievance its policy required, did not give her a fair opportunity to answer the allegations or question witnesses, and did not arrange a hearing of her appeal. The company had said the dismissal was justified, fair and proportionate.
