The Workplace Relations Commission awarded former Xerotech Limited (In Liquidation) CEO/CTO Barry Flannery €420,172 in compensation after finding he was unfairly dismissed by constructive dismissal. Adjudication Officer Breiffni O'Neill's decision was dated 19 March 2026.
Flannery alleged that the company removed his system access, intercepted communications and excluded him from his operational role, leaving him no reasonable alternative but to resign. Xerotech did not attend the hearing or give evidence. The officer found that the company removed access to critical systems, redirected communications and failed to raise allegations or follow a procedure, meeting the tests for constructive dismissal.
