The Workplace Relations Commission awarded Patrick Roche €5,184 after finding Enniscoffey Bar & Grill Limited unfairly dismissed him for making a protected disclosure. It also ordered the company to pay €972 compensation for failing to provide written employment terms. The decision was dated 22 April 2025.
Roche said he raised food hygiene concerns with his supervisor and the Food Safety Authority before his dismissal. The company cited a downturn in business and staff complaints, then later referred to performance and conduct issues. The adjudicator found those explanations inconsistent, noting there were no contemporaneous performance concerns and that the company advertised for staff despite citing a downturn.
The WRC found the separate workplace-safety penalisation complaint not well founded because it concerned the same dismissal addressed in the unfair-dismissal decision.
