WRC rejects nurse’s discrimination and protected disclosure complaints

The Workplace Relations Commission found both complaints by Arun Raj Cheviri Kunhambu against the Health Service Executive not well founded. Adjudication officer Catherine Byrne’s decision was dated 3 July 2025. Kunhambu alleged race and disability discrimination after he was refused paid leave under the HSE’s Serious Physical Assault Scheme following a patient restraint, and said he was penalised for protected disclosures. The HSE said the incident did not meet the scheme’s criteria and denied discrimination or penalisation. Byrne found no evidence he had been assaulted and concluded that his communications concerned a grievance and efforts to obtain scheme leave, rather than protected disclosures. No award was recorded.
