WRC finds Severica Petronel Irimia was not unfairly dismissed

The Workplace Relations Commission found that Severica Petronel Irimia was not unfairly dismissed after he complained about work breaks and said his dismissal followed that complaint. The WRC said his concern was a workplace grievance affecting him alone, not a protected disclosure. Adjudication Officer Elizabeth Spelman dated the decision 19 February 2025. Irimia said he was dismissed for poor performance after raising concerns about breaks and denied refusing work call-outs. Absolute Drain Services Ltd. t/a Greenday Environmental said he had refused to complete three call-outs a day and denied he made a protected disclosure. The officer found Irimia had worked for the company for nine months and was not unfairly dismissed. The complaint was not well founded, and no compensation was awarded.
