The WRC found Ciaran Carey was not unfairly dismissed by Profile Developments Unlimited Company in a decision dated 4 December 2024. Carey had claimed constructive dismissal, which is when an employee ends their employment because of their employer’s conduct. Carey declined to give evidence at the hearing but said he was not withdrawing his complaint. The adjudicator said the burden of proving constructive dismissal rested with him and, without evidence, the complaint was not well founded.
