The Workplace Relations Commission rejected Thomas Giles’s unfair dismissal complaint against Kemek Limited and recorded no compensation award in a decision dated 10 April 2026. Giles argued his dismissal was predetermined and linked his conduct to long working hours. The company said it dismissed him for gross misconduct over vehicle and fuel card use, including unusually high fuel consumption and alleged refuelling of other vehicles and canisters. The adjudicator found the company conducted a fair investigation and that dismissal was within the range of a reasonable employer’s response.
