A Workplace Relations Commission adjudication officer rejected Donna Caden’s constructive dismissal claim against Bord Gáis Energy Limited, finding that her resignation did not meet the legal threshold. Adjudication Officer David James Murphy dated the decision 5 May 2026. Caden had alleged that changes to her marketing role and exclusion from a brand repositioning project led her to resign in August 2024.
Murphy found there had been temporary disruption to Caden’s role and that the company was unreasonable in not addressing a manager’s earlier view that she should leave the role. He concluded that this was not serious enough to amount to constructive dismissal, while the project’s outcome remained unclear and Caden had not returned to test the temporary arrangements. Her claims concerning written employment terms, notice and unpaid overtime were also rejected; she withdrew separate unfair dismissal and redundancy complaints at the hearing. No compensation was awarded.
