WRC rejects John Paul Nolan’s driver subsistence claim

The Workplace Relations Commission rejected John Paul Nolan’s claim for driver subsistence from McCarthys Homevalue Ltd, finding the payment was an employment expense rather than wages. Adjudication Officer Gaye Cunningham dated the decision 9 December 2024. Nolan said other drivers received subsistence and that he had to eat lunch in his cab after driving around the county. The company disputed that other drivers all received it and said the payment did not apply to him. The officer also found Nolan did not qualify under the cited Revenue and Road Hauliers guidance.
