The Workplace Relations Commission has ordered Genius Ltd to pay former assistant manager Roberta Girinelli €13,500 after finding she was unfairly dismissed. The decision was dated 19 December 2024.
Genius Ltd said Girinelli frustrated her contract by attending a job interview and a two-day work trial while employed. Girinelli said she attended the interview during her lunch break, requested leave for a trial day and had the director’s consent; she said no job offer was made.
The WRC officer found the company dismissed her without investigating, holding a disciplinary process or giving her a fair chance to respond. The officer also found no evidence she had taken other employment and said no reasonable employer would have dismissed her in the circumstances.
