WRC rules it lacks jurisdiction over Traveller discrimination complaint at licensed premises

The Workplace Relations Commission said it had no jurisdiction over Tina Berry’s complaint alleging Traveller community discrimination at Phoenix Inn Limited t/a Kestrel House, whose premises were identified in the decision as the Kestrel Inn. The decision was dated 14 November 2024. The respondent argued that the complaint fell within the District Court’s jurisdiction under section 19 of the Intoxicating Liquor Act 2003. Berry sought an adjournment while a High Court appeal and possible judicial review were pending, and her representatives argued the provision was incompatible with the Equal Status Act. The WRC made no award.
