The Workplace Relations Commission found that Denis Coakley was fairly dismissed by Ashgrove Plant Limited t/a Ashgrove Recycling & Waste Management after he failed to report a crash involving his truck until several hours later. The WRC decision was dated 11 September 2024. Coakley argued that flaws in the disciplinary process and the severity of the penalty made his dismissal unfair. The company said there were substantial grounds for dismissal and that it had acted fairly. Adjudication Officer Thomas O’Driscoll said the conduct was reckless and dangerous, and that the case against Coakley outweighed the procedural flaws. He rejected the unfair-dismissal complaint and found Coakley was not entitled to minimum notice because he had been fairly dismissed for gross misconduct.
