Apple Distribution International Limited must pay employee Thomas Delecolle €2,250 after the Workplace Relations Commission found it had failed to provide updated terms and conditions for his work as a manager.

In a decision dated 11 September 2024, the WRC found one of three complaints well founded. Delecolle had also complained about Sunday premiums and time records. The WRC found the working-time complaint not well founded because the issue had been remedied through Apple’s grievance process and backpay had been paid, and rejected the other terms complaint because the cited legal provision did not apply.

Apple said it had issued an updated contract in March 2024, setting out a 33% Sunday premium and stating that managers were not eligible for overtime. The WRC said the lack of clarity had since been addressed, but awarded compensation for the upheld complaint.
