WRC rules Damien McLellan’s constructive dismissal complaint out of time

The Workplace Relations Commission ruled it had no jurisdiction to hear Damien McLellan’s constructive dismissal complaint against Carlow College, St. Patrick’s because it was out of time. The decision was dated 16 December 2024. McLellan alleged that he had surrendered his lecturer contract expecting further work if the Social Care Course continued. The WRC found his employment ended on 30 June 2023 and that subsequent voluntary assistance and a separately paid guest lecture did not extend the employment relationship. It did not hear the substantive dismissal claim.
