WRC rejects tenant’s discrimination complaint over HAP and tenancy

The Workplace Relations Commission found landlord Leslie Salter did not discriminate against Khalil Ahmed on the housing assistance ground over his Housing Assistance Payment application and the end of his tenancy. The decision was dated 13 August 2024; no compensation was awarded.

Ahmed said Salter had agreed to accept HAP but failed to complete the application form, and served notice after the council sought repayment of €550 from a €1,400 deposit. Salter said he completed the form, engaged with the council and refunded the €550 overpayment. He said he ended the tenancy because of ongoing complaints about the property.

The WRC found Salter had completed the form and engaged with the council. It found the tenancy ended because of ongoing property complaints, not Ahmed’s HAP status, and concluded Ahmed had not established facts sufficient to raise a presumption of discrimination.
