WRC orders The Food Point Limited to pay worker €2,926.39 in unpaid wages and leave

The Workplace Relations Commission ordered The Food Point Limited to pay Deivission Bernabe €2,926.39 for unpaid November wages and accrued annual leave. The WRC also upheld his Sunday-premium complaint, ordering €354.67 gross for financial loss and €500 compensation for breach of statutory rights. The WRC decision was dated 10 February 2025. Bernabe said he worked ten Sundays during the relevant period, usually eight hours each. The company argued that his €13.30 hourly rate included a Sunday premium, but his contract was silent on the issue and the company provided no evidence of additional compensation. Bernabe’s minimum-wage complaint could not be heard because he had not requested a written statement of his average hourly rate. The WRC said he could re-enter that complaint after complying with the requirement, subject to time limits. His separate claim for payment in lieu of notice was not well founded: he had not worked the 13 weeks required for statutory notice.
