The Workplace Relations Commission found an anonymised technician was not unfairly dismissed after resigning, rejecting his constructive dismissal complaint. Adjudication officer Brian Dalton’s decision was dated 13 February 2026. The complainant said remote work was withdrawn and that he was asked to consider his position after sick leave. The Anonymised Design Contractor denied forcing him to resign, saying project work required on-site attendance while flexible hours remained available. The officer found no fundamental breach or pattern of unreasonable conduct sufficient to justify resignation. He said the end of remote work could have been communicated better, but the threshold for constructive dismissal was not met.
