The Workplace Relations Commission rejected Manouj Sharrma’s complaints of unfair dismissal and penalisation for making a protected disclosure, with no award recorded. Adjudication Officer Breiffni O'Neill’s decision was dated 13 May 2025.
Sharrma alleged that he was treated unfairly and dismissed after raising workplace safety concerns, including that a liquid nitrogen cylinder had been used as a door stop. The officer found that report was a protected disclosure, but found no connection between it and either the refusal of his request to leave work briefly or his dismissal. McArdle Transport Limited T/A McArdle Skeath said he was dismissed for undermining managers and failing to accept instructions.
His complaints under the Industrial Relations Act and Health Act were withdrawn.
