WRC finds disability discrimination in Kilkenny worker's dismissal

The Workplace Relations Commission found that Kilkenny Limestone Quarries Limited discriminated against Kristian Browne by dismissing him on disability grounds. In a decision dated 19 September 2024, it ordered the company to pay him €3,000 and provide diversity and inclusion training for management, supervisors and HR within six months.

Browne said he was dismissed because of his seizures. The company said he failed probation because of his work performance. The WRC cited his dismissal within days of a seizure, the lack of evidence for alleged poor performance and the absence of probation reviews. It found that Browne had not established his separate complaint that the company failed to provide reasonable accommodation. The compensation also took account of his lack of candour at the hearing.
