The Workplace Relations Commission found Bus Eireann failed to provide reasonable accommodation to bus driver Dede Kroni and directed it to restore his 7am to 4pm roster. The decision was dated 2 July 2024.
Kroni, who had worked for Bus Eireann for 16 years, said regular hours were needed because fatigue was a symptom of his disability. The company said the bespoke shift was temporary and difficult to maintain, and that it had offered other roles. The adjudicator found the roster was withdrawn because of an agreement prioritising spare drivers, and that the alternative roles did not meet the agreed need. The roster must remain unless the parties agree to change it or an occupational health consultant finds it unnecessary.
