The Workplace Relations Commission ruled that it had no jurisdiction to hear four complaints over a transfer of undertakings because they were filed outside the statutory time limit. The decision, dated 1 October 2024, ended proceedings involving 29 complaints by Mr Ayeyemi Adeba against Manguard Plus Limited before the substantive issues were heard. Adeba worked as a static security officer and said health difficulties and efforts to pursue the matter through his trade union explained his late filing. Manguard Plus argued the complaints were out of time and disputed its continuing liability after the transfer. The adjudication officer found Adeba had not shown reasonable cause for an extension, noting his continued engagement with the union during the relevant period. The merits were not decided.
