The Workplace Relations Commission found Neville Hotels Limited unfairly dismissed Ksenija Bakic but awarded nil compensation. The decision was dated 31 January 2025.
Bakic worked as an accommodation assistant until her dismissal on 7 December 2023. She said the hotel dismissed her unfairly after a dispute with a supervisor and that she could not properly defend herself. The hotel said it dismissed her after an investigation, disciplinary hearing and appeal following a serious incident, against a background of earlier disciplinary sanctions.
The adjudicator found that unclear information about representation at investigation and appeal stages impaired Bakic’s opportunity to obtain adequate representation, making the dismissal unfair. The adjudicator also found that Bakic contributed very significantly to her dismissal and that there was no evidence of efforts to mitigate financial loss, and considered nil compensation just and equitable.
