The Workplace Relations Commission ruled that it had no jurisdiction to hear Victor Ogiemudia’s unfair dismissal complaint against Tesco Ireland Limited, in a decision dated 1 March 2024. The merits were not decided. Ogiemudia worked for security company OCS Limited and was assigned to Tesco stores. After a store manager asked for his removal, he was laid off for several months while OCS sought another role. Ogiemudia said he was not told why he was moved and had lost earnings. The officer found that OCS remained Ogiemudia’s employer and that there was no evidence it had ended his employment. Tesco was not his employer, so the WRC could not consider the unfair dismissal complaint.
