The Workplace Relations Commission found that Bettystown Leisure Ltd t/a Integral Fitness and Leisure did not victimise Nedas Juknevicius when it refused to renew his gym membership. The complaint was not well founded, the WRC said in a decision dated 17 July 2024. Juknevicius said the refusal followed his complaint about an instructor’s conduct toward his wife during a class. The gym said it investigated and found no inappropriate conduct, and that it declined renewal because of confrontations with staff. The adjudicator found no discrimination on any of the grounds under the Equal Status Act and said the gym was entitled to refuse renewal in light of the incidents. A separate race discrimination complaint was withdrawn at the hearing.
