The Workplace Relations Commission awarded Peter Maher €500 after finding that St Mary's Campus Limited dismissed him unfairly from a Community Employment scheme without a proper investigation or considering alternatives to dismissal.
In a decision dated 11 September 2024, the adjudication officer accepted the employer’s witnesses’ evidence that Maher had received warnings and had behaved disruptively. The officer nevertheless found the dismissal procedurally unfair because the employer did not investigate the events, provide paperwork about its decision or consider alternatives.
The officer found Maher contributed substantially to his dismissal and took that into account when setting compensation at €500, which the decision described as about two weeks’ wages.
