The Workplace Relations Commission found Geraldine Baxter was unfairly dismissed by Little Sisters of The Poor and ordered the employer to pay €65,520 compensation and €5,040 in notice pay. The decision was dated 23 January 2025.
Baxter, an HR Manager, had challenged her dismissal over allegations concerning timekeeping, overtime and annual leave records. The employer said it followed correct procedures and that the dismissal for gross misconduct was fair.
The adjudication officer found that the investigation added allegations without interviewing Baxter again, and that evidence supporting her account of approved annual leave was disregarded. The officer also found that her suspension continued until dismissal despite being linked to completion of the investigation.
