The Workplace Relations Commission rejected Tomas Ruksnys’s unfair dismissal complaint, finding his job loss resulted from redundancy after a construction project ended. The WRC decision was dated 8 April 2024. Ruksnys said he was dismissed while on long-term sick leave after a workplace injury, without procedures. Killark Ltd said the Intel construction phase had finished, its need for workers had fallen and it had no other work for him or five colleagues. The adjudicator found that the project had ended and no other work was available. Ruksnys had one year and five months’ service, short of the two years needed to qualify for statutory redundancy pay.
