The Workplace Relations Commission awarded Mary O'Dell €52,368.75 in compensation after finding that her dismissal by Layer Digital Solutions Limited was unfair. The WRC also ordered the company to pay her €38,819.38 for unpaid wages.

The decision was dated 20 March 2024. O'Dell worked as a Senior Client Delivery Manager, and her employment ended in September 2023. She told the WRC that she had not received wages since April 2023 and was also owed pension contributions and holiday pay. Her employment terms included a company pension match of up to 5% of her gross salary.

The company did not attend the hearing and gave no explanation. The adjudication officer said the employer had failed both the contract test and the reasonableness test. In plain terms, the officer found that the employer’s conduct breached the employment relationship and that the dismissal was unreasonable. Both complaints were found well founded. The €38,819.38 wage award was ordered in addition to the unfair-dismissal compensation.
