WRC rejects age discrimination complaint against Aviva over open-driving cover

The Workplace Relations Commission found Liam Scott was not discriminated against by Aviva Insurance Ireland Dac over an age limit on optional open-driving cover under his brother-in-law’s motor policy. The decision was dated 2 December 2024.

Scott said he was excluded because he was over 70. Aviva denied discrimination and argued the limit was justified under the insurance exemption in the Equal Status Act. The adjudicator found Scott had established less favourable treatment based on age, but accepted Aviva’s actuarial evidence and found its data and other underwriting or commercial factors reasonably supported the limit. The complaint was not well founded and no award was recorded.
