The Workplace Relations Commission (WRC) has ordered Millbay Fishing Company Ltd to pay fisherman Francis Egyir statutory redundancy after finding that payments under a vessel-cessation scheme did not replace his legal entitlement. The decision was dated 4 March 2024.
Egyir worked for the company from December 2019 until May 2023. He said he received €2,000 in crew compensation when he believed he was due €3,000. The company opposed both complaints, arguing that the scheme payment was in lieu of redundancy.
The officer found that Egyir qualified for statutory redundancy and that the scheme guidelines did not remove that entitlement. The WRC also rejected his separate Payment of Wages complaint: he had not completed three full years of service by the scheme’s 18 November 2022 application deadline.
