The Workplace Relations Commission ordered Millbay Fishing Company Ltd to pay statutory redundancy to fisherman Gordon Kojo Monkah after finding his complaint well founded. The decision was dated 4 March 2024.
Monkah worked for the company from August 2018 to May 2023 under the Atypical Work Permit Scheme for Non-EEA Fishers. He argued that compensation paid to the vessel owner under a scheme for decommissioning fishing vessels did not replace his statutory redundancy entitlement. The company said a payment already made to him was in lieu of redundancy.
The adjudication officer found Monkah met the eligibility criteria and that the decommissioning scheme guidelines did not say crew payments replaced employees’ redundancy rights. The company was ordered to pay the statutory redundancy payment within 42 days. The decision does not state the individual amount due.
