The Workplace Relations Commission rejected Martynas Januskauskas’s unfair dismissal and payment of wages complaints against Killark Ltd. The decision was dated 1 March 2024. Januskauskas said he was dismissed while on sick leave and should have been considered for other work. He also sought travel-time pay for holidays and bank holidays. Killark said work at the Intel site had diminished, no alternative work was available and the dismissal was for redundancy; it disputed travel-time pay for days he did not work. The WRC accepted that the need for workers at the site had diminished and found a redundancy situation. It said being on sick leave did not prevent a redundancy dismissal. It also found no statutory right to travel-time pay on days when Januskauskas was not travelling.
WRC rejects two complaints against Killark Ltd.
