The Workplace Relations Commission rejected Aidan O'Mahony's age discrimination complaint over his compulsory retirement at 60 from the Irish Prison Service, finding the retirement rule objectively justified by legitimate aims including prison safety and workforce planning. The decision is dated 30 June 2026.
O'Mahony argued that colleagues had been allowed to continue working beyond 60. The WRC found the proposed comparators did not establish inconsistent treatment: three had not reached their applicable retirement age, while a former governor had retired at 60 and later returned under a separate, unestablished contract. The WRC also rejected his complaint that he had not received written employment terms, finding he requested and received his signed 1987 contract rather than a statutory statement. A separate age discrimination complaint was withdrawn at the hearing. No compensation was ordered.
