The Workplace Relations Commission upheld four complaints by plumber Pat O'Connell against Earthworks Profiling Limited, including claims over notice, written employment terms and holiday pay. The decision was dated 8 May 2024. The WRC awarded O'Connell €2,548 for unpaid minimum notice, €2,548 for the failure to provide written employment terms and €637 for five days of holiday pay. It also found that he was entitled to a statutory redundancy lump sum, subject to confirmation of insurable employment, based on service and gross weekly pay of €637. The respondent did not attend the hearing, although the WRC said it had been notified. The adjudicator granted an extension after finding reasonable cause for the complaints being filed outside the usual six-month time limit. The decision gives inconsistent end dates for the redundancy service calculation; the redundancy entitlement is stated without a lump-sum figure.
