The Workplace Relations Commission allowed Michael Mikhailevich’s appeal and found he was entitled to a statutory redundancy lump sum, subject to having been in insurable employment during the relevant period. The decision was dated 2 April 2024. Mikhailevich, an apprentice carpenter, was laid off in March 2023 after a downturn in work. His employer, Dh Contractors Limited, said it had found him alternative work with another company, which he refused. The adjudicator found he was entitled to refuse that offer and that the company had not directly offered suitable work during the layoff or within seven days of his redundancy request. The payment was to be calculated using a gross weekly wage of €533.53, with the layoff period excluded.
