The Workplace Relations Commission found that Monica Torras Perez’s complaint of age and race discrimination was not well founded. The decision, dated 20 March 2024, concerned her unsuccessful application for a fixed-term physical education teaching post at Gorey Educate Together Secondary School.
Torras Perez had taught physical education and Spanish at the school during the previous academic year. She questioned the interview process and scoring after she was not selected. The school said the vacancy had to be advertised and assessed through a selection process; Torras Perez ranked fourth, while the successful candidate had ranked second after the top-ranked candidate accepted a job elsewhere.
The adjudication officer found that Torras Perez had not established facts showing that the appointment decision was because of her age or Spanish nationality. Under the legal test, she first had to provide evidence that could support a presumption of discrimination; the officer found she had not met that threshold, so the burden did not shift to the school.
