WRC dismisses Rabson Ndlovu’s discrimination complaint as out of time

The Workplace Relations Commission found Rabson Ndlovu’s race discrimination complaint against Ttm Healthcare was submitted outside the 12-month time limit and dismissed it without deciding whether discrimination occurred. Adjudication Officer Peter O'Brien’s decision was dated 5 December 2024. Ndlovu alleged that he was denied a job with a third party because of his race after discussions with Ttm Healthcare. The agency denied discrimination and argued the complaint was out of time. The adjudicator found no alleged discriminatory act within the relevant period and said he had no jurisdiction to decide the substantive complaint.
