WRC excludes Veaceslav Gafton’s unfair dismissal complaint over short service

The Workplace Relations Commission excluded Veaceslav Gafton’s unfair dismissal complaint because he had about three months’ service, below the 12 months required by the Unfair Dismissals Act. The WRC decision was dated 14 November 2023. Gafton said he began work at Rice Transport And Comercial Repairs on 13 March 2023 and his employment ended on 7 June 2023. The respondent did not attend the hearing, but the decision turned on Gafton’s service length. The complaint was excluded from the Act’s protections, so the merits were not decided.
