Labour Court rejects DHL driver’s appeal over working-hours notice

The Labour Court rejected Alan Mcandrew’s appeal over notice of his working hours, finding that occasional roster errors did not show he was generally denied advance notice. In a determination dated 14 November 2023, the Court said the appeal failed and varied the Adjudication Officer’s decision. McAndrew said DHL Supply Chain (Ireland) Limited did not notify him of his hours at least 24 hours before work began. The Court found DHL used written rosters to notify drivers in advance and that occasional errors were corrected after McAndrew phoned the office. It concluded the evidence did not support his claim under the Organisation of Working Time Act 1997. McAndrew worked as an HGV driver at DHL’s Donabate depot. This determination dealt only with his working-hours notice complaint; he had also appealed separate decisions under other employment laws.
