WRC says it had no jurisdiction over four late complaints

The Workplace Relations Commission ruled that it had no jurisdiction to hear four complaints brought by Arkadiusz Brzezinski against Aronmar Plant Limited. The decision was dated 4 December 2023. The officer found no reasonable cause to extend the filing deadline, so the merits were not decided. The complaints concerned Sunday premiums, working hours and written terms of employment. Mr Brzezinski said he had not received a contract, English was not his first language, and he returned to Poland for treatment after a workplace accident before seeking advice. The company’s representative said he had sought legal advice within the six-month limit. The adjudication officer concluded that the circumstances described did not explain the delay or establish a causal link between those circumstances and the late complaints. The four claims were therefore out of time.
