The Workplace Relations Commission found that Alan Walsh had not established disability discrimination by the HSE in its handling of his information requests. Adjudication Officer Gaye Cunningham’s decision, dated 20 May 2024, said Walsh had not shown that a comparable service user without a disability, or with a different disability, received more favourable treatment.
Walsh said the HSE failed to respond to requests and complaints on time and treated him differently because of his disability. The HSE denied discrimination and argued that the complaint was outside the statutory time limit. The WRC noted delays in processing his information requests but found no prima facie case of discrimination. It also said it lacked jurisdiction to consider older complaints dating back about 12 years.
