The Workplace Relations Commission found Jolanta Burzynska’s discrimination complaint against The Governor and Company of the Bank of Ireland not well founded after the bank declined her mortgage application. The decision was dated 20 May 2024.

Burzynska said the refusal involved discrimination on civil status, sexual orientation, race and age grounds. The bank denied discrimination and said its assessment found she could not meet the repayment requirements.

The adjudication officer found no evidence that Burzynska was treated less favourably on any of the four grounds. She accepted that the application was declined because Burzynska could not meet the repayment requirements, including a stress test that checks whether a borrower could afford repayments if interest rates rise.
