The Workplace Relations Commission rejected Katlyn Winston’s unfair dismissal complaint against Rotunda Hospital, finding she had not shown that the hospital’s conduct left her no alternative but to resign. Adjudication Officer Catherine Byrne’s decision was dated 4 March 2025.

Winston alleged that a porter touched her waist at work and that the hospital failed to make clear how it would keep her safe. The hospital’s independent investigation upheld her complaint about the touching; the porter received a final written warning and was moved from theatre work. The hospital said it took steps to support Winston and prevent a recurrence. The WRC found the hospital made reasonable efforts to support her and noted that she had not used its grievance procedures before resigning.

The WRC also ruled that it had no jurisdiction to hear Winston’s gender discrimination complaint because it was submitted outside the statutory time limit; it did not decide that complaint on its merits.
