WRC rejects cabin crew member’s constructive dismissal complaint against Emerald Airlines

The WRC rejected Carl Allen’s constructive dismissal complaint against Emerald Airlines Ireland Limited, finding that he left his job voluntarily. Allen, a cabin crew member, said he felt unwelcome after being reinstated and later lost another airline’s job offer after a negative reference. In a decision dated 1 November 2023, the adjudication officer found Allen had not raised a grievance and had chosen to seek work elsewhere. The reference was given after he resigned and did not cause his decision to leave. The officer also found the airline followed its procedures and did not commit a significant breach of his employment contract.
