The Workplace Relations Commission found that William Ye was unfairly dismissed by Emerald Court Chinese Restaurant and directed it to pay him €1,500 compensation. The decision was dated 1 November 2023.
Ye worked as a delivery driver from January 2020 and said he earned €5 an hour. He told the WRC that he was dismissed by text on 24 March 2023 after asking for a pay increase. The restaurant’s owner was notified of the hearing, but no one attended for the respondent.
The adjudication officer said the restaurant gave no explanation or notice and had not provided Ye with a dismissal procedure. The €1,500 compensation was based on about four weeks’ wages at the legal minimum rate of €11.30 an hour. The decision also recorded that Ye had not looked for another job after his dismissal.
