The Workplace Relations Commission found Siobhan Keely’s constructive unfair dismissal complaint against Guerbet Ireland Ulc not well founded. Keely said she resigned after intimidation and harassment at work, including being moved from her usual work area and difficulties with her manager. The WRC decision, dated 3 November 2023, records that Keely worked for Guerbet from 2006 and became an inventory co-ordinator in 2013. The company said it offered grievance procedures and mediation. The adjudication officer found Keely did not use the grievance process or continue with mediation, and had secured another job before resigning. The officer concluded Keely had not established constructive dismissal and did not uphold the complaint. In plain terms, the WRC found she had not shown that the employer’s conduct forced her to resign.
