The Workplace Relations Commission found Remigwus Gabertas’s complaint against Uber Ireland was not well founded after ruling he did not fall within the scope of agency-worker legislation. The merits were not decided. Gabertas, a self-employed taxi driver who used Uber’s app, said the company suddenly removed his access after two customer complaints, without investigating his account or providing an appeal route. He said he had completed more than 1,700 trips over about three and a half years. Uber did not attend the hearing, but the adjudicator said it had been notified. The adjudicator described the process as unreasonable and unfair, but said the law covered agency workers and Gabertas did not meet its definition. The decision was dated 6 November 2023.
