The Labour Court has affirmed a finding that Zhihua Yuan’s complaint against Gaffney Mechanical Limited was not well founded under Schedule 2 of the Employment Permits Act 2006. The decision is dated 30 September 2026. Yuan alleged Gaffney Mechanical contravened the Act by redirecting him to another company. He said he remained its employee, relying on a signed contract and employment permit naming the company. Gaffney Mechanical said it did not employ him after his arrival in Ireland. The Court found Yuan had not established that he worked for Gaffney Mechanical during the relevant period or that it had a legal relationship with the other entity that employed him. It affirmed the Adjudication Officer’s finding that the complaint was not well founded.
