The Workplace Relations Commission found Gráinne Flannery’s unfair dismissal complaint against Mercer not well founded. The decision was dated 15 January 2024. Flannery said her redundancy was unfair and linked to earlier WRC complaints. Mercer said it outsourced some administrative work to India, reducing the need for Dublin staff, and used a scoring matrix to select among four administrators. The WRC accepted the business reason for reducing Dublin roles and found the selection process substantially fair and transparent. Flannery scored lowest, largely because of her performance reviews over the previous three years. The officer had concerns about referring an at-risk employee to an internal jobs portal, but found Mercer met its consultation duty because Flannery did not express interest in another role.
