The Workplace Relations Commission awarded Sean Mc Kenna €3,159 after finding that M1 Document Solution Limited unfairly dismissed him. The decision, dated 23 April 2025, concerned the company’s dismissal of Mc Kenna for alleged gross misconduct after he did not drive to Macroom as instructed while transporting confidential waste.
The company said Mc Kenna continued driving after reporting fatigue, despite an instruction to stop, and said it held a disciplinary process and appeal. The WRC found the process unfair, citing perceived bias arising from family connections among those involved and the lack of an opportunity to test allegations. It assessed compensation at 25% of his stated financial loss.
